Santos is facing charges under Section 92 of Republic Act 9165, the Comprehensive Dangerous Drugs Act, for bungling drug cases.

The court had previously dismissed the charge of planting evidence against him, an offense the other 28 officers now face.

Santos posted P200,000 bail for his temporary liberty and was subsequently released from CIDG custody.
