DOJ orders NBI to probe fake news on novel coronavirus

Justice Secretary Menardo Guevarra ordered the National Bureau of Investigation (NBI) to investigate the spread of fake news concerning the 2019 novel coronavirus acute respiratory disease (2019-nCoV ARD).

Department Order No. 052 directs the NBI to conduct investigations and case build-up on deliberate misinformation and false reporting related to the virus.

Guevarra warned that those responsible for spreading fake news with the intent to create or aggravate public disorder, or undermine government efforts during a state of public emergency, may face charges under the Revised Penal Code in relation to the cybercrime prevention law.

He initiated the directive after concerns were raised during a Senate inquiry and after personally observing communications that sow panic and confusion.

The NBI is also tasked to assist the Department of Health in contact tracing individuals exposed to the virus.

Guevarra stressed that while freedom of speech is a constitutional right, it has limitations when it affects the greater interest of the public and undermines coordinated government efforts.

He emphasized that distractions to government efforts in overcoming the nCoV threat will not be tolerated.
