Duque files motion to dismiss P1.6B graft case over DOH funds

Former Health Secretary Francisco Duque III has filed a motion with Sandiganbayan to dismiss the P1.6 billion graft case against him and former budget undersecretary Lloyd Christopher Lao.

The graft charges stem from the controversial transfer of P41.46 billion worth of DOH funds to PS-DBM in 020 for pandemic-related procurement, including test kits, personal protective equipment (PPE), mechanical ventilators, and medical masks.

Duque argues that he authorized the transfer under Executive Order 359, which allows PS-DBM to charge a service fee, and maintains his actions were necessary during the national public health emergency declared by President Duterte.

The Ombudsman claims Duque's decision slowed down procurement and caused additional costs, while Duque counters that the element of damage or injury to government is absent due to the context of the pandemic.

Due to Duque’s motion, the arraignment scheduled for Monday, September 30, has been postponed to a later date.
