ConsumerUnion files petition against Naia concession agreement

ConsumerUnion-Philippines Inc. filed a petition before the Regional Trial Court of Manila on Wednesday seeking to declare certain provisions of the Ninoy Aquino International Airport (Naia) concession agreement invalid.

The group argues that specific sections of the Concession Agreement and MIAA Revised Administrative Order No. 1 violate the PPP Code and delegation rules, rendering them illegal, arbitrary, and discriminatory.

ConsumerUnion is challenging provisions concerning adjusted rates for fees and charges at Naia, claiming they are unjust and unreasonable and against public policy.

The petition names several respondents including the Department of Transportation, Manila International Airport Authority, New Naia Infra Corp., and the Office of the Solicitor General.

MIAA spokesperson Chris Bendijo stated that while respecting the right to judicial remedies, the process leading to the Concession Agreement has been transparent and in accordance with law.
