SC stops Comelec from cancelling Marquez's COC

The Supreme Court (SC) has issued a temporary restraining order (TRO) against the Commission on Elections (Comelec) to stop the enforcement of its resolution cancelling the certificate of candidacy (COC) of senatorial aspirant Norman Marquez.

The Comelec had declared Marquez a nuisance candidate in a Dec. 13, 2021 resolution for the May 9, 2022 polls.

The TRO was issued on Wednesday, Jan. 19, and is effective immediately until further orders from the court.

The SC directed the Comelec to comment on Marquez's petition within a non-extendible period of 10 days.

It remains unclear whether Marquez's legal challenge can still lead to his inclusion in the senatorial race, as the Comelec is set to finalize and print ballots as early as Thursday, Jan. 20.

This is not the first time the Comelec has cancelled Marquez's COC, having done so in 2019 for the same senatorial election.

At that time, the Comelec cited that Marquez was 'virtually unknown' and lacked proof of financial capability for a nationwide campaign.
