SC junk mining ban in Occidental Mindoro

The Philippine Nickel Industry Association (PNIA) supports the Supreme Court's decision to nullify the 25-year mining ban in Occidental Mindoro.

PNIA considers the ruling a pivotal win for the mining sector, stating it clarifies the jurisdiction between local and national governments and creates a more secure investment climate by removing uncertainty caused by local bans.

The Supreme Court ruled that the provincial government exceeded its powers in enacting ordinances that completely banned large-scale mining.

In a decision penned by Senior Associate Justice Marvic Leonen, the Supreme Court stated that the Philippine Mining Act does not authorize local government units to impose a blanket ban on large-scale mining, though they are involved in processing mining project applications.

The group believes the decision enhances the industry's competitiveness and fosters its sustainable development.

PNIA affirmed its support for environmental protection in mining, provided it is conducted within the bounds of national laws.

The association also agrees that mining projects must undergo stringent environmental assessments and stakeholder consultations.
