CTA dismisses BUSECO plea on P23.5M tax assessment

The Court of Tax Appeals (CTA) dismissed Bukidnon II Electric Cooperative's (BUSECO) plea to cancel a P23.5 million income tax assessment from 2018.

BUSECO had filed a petition seeking to nullify the assessment issued by the Bureau of Internal Revenue (BIR) in Cagayan de Oro City.

The tax court ruled that BUSECO incorrectly treated the BIR's reply letter as a final decision on its protest.

Consequently, the CTA dismissed the case for lack of jurisdiction, citing that BUSECO did not follow the proper appeal process.

The CTA emphasized that appeals must be made against the Commissioner of Internal Revenue's decisions on disputed assessments, as per Republic Act No. 1125.
